LII Legal Posting Lab
We invite everyone interested in the subject of posting workers to France and Belgium for the 52nd meeting in the series of Legal Posting Lab. On July 16, we will meet again online via the Zoom platform. For the first time, the Lab will be held in English. It will be led by Belgian lawyer Tanel Feldman, Supporting Member of the Labour Mobility Initiative Association.
Posting workers to Belgium and France after 30th July 2020
The subject of the Lab will be the posting of workers to Belgium and France after July 30, 2020. On this day, the amended Posting of Workers Directive (Directive 2018/957 amending Directive 96/71/EC) will come into force. A detailed program of webinar can be found below.
Programme of the Lab (the same issues for both Member States):
1. Remuneration – how to calculate, where to find information
2. Long term posting – calculating, interrupting and extending the period of posting
3. Cumulative calculation of posting periods of few posted workers
4. All applicable employment conditions – where to find them?
5. Travel and board cost reimbursement
6. Conditions of accommodation
France – specific problem:
7. Will the employment on the French terms and conditions (long term posting) be a criterion in determining a habitual, continuous and stable activity in France?
8. Q&A session (questions sent beforehand will be answered first).
Speaker – Tanel Feldman
Senior Partner at Immigration Law Associates, Tanel Feldman focuses his practice on EU labour mobility. Tanel works to promote a better relationship between academic debate and practice and defends the principle of primacy of EU law as an opportunity rather than a constraint. Assisted by an experienced team and supported by a network of partners across the EU, Tanel provides in-depth advice on rights and obligations triggered by the cross-border element of given legal situations.
Member of different associations and organisations such as the European Law Institute and the International Bar Association, Tanel promotes EU law as a “new legal order of international law”. He is also a Supporting Member of Labour Mobility Initiative.
The Lab will be held in English (without translation) in the form of a webinar on the Zoom platform on Thursday, July 16 between 11-14:00. Registration can be done by sending an e-mail application to the address firstname.lastname@example.org. The application should contain the name of the participant (participants), company / institution name, email address and telephone number as well as invoice information (in the case of paid participation). We are waiting for applications until July 10, 2020. The cost of participation in the webinar for LMIA Members is 300 PLN net/person, and for people outside the association – 750 PLN net/person (it is possible to issue an invoice in EUR).
